2. TERMS OF COMMERCIAL ENGAGEMENT
All creative services, digital deliverables, and design advisory packages provided by WebCraftiva are governed by explicitly contracted Statements of Work (SOW) executed between the Client and WebCraftiva. No service engagement commences without written or digital confirmation of scope, timeline, and investment.
Upon complete settlement of agreed commercial invoices, WebCraftiva assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, visual assets, and digital creations directly to the Client. No recurring licensing fees or royalty obligations apply post-settlement.
WebCraftiva reserves the right to display anonymized case studies and portfolio excerpts of completed work unless the Client provides explicit written objection within 14 calendar days of project completion.
All project timelines quoted are estimates in business days. Delays caused by third-party dependencies, client feedback cycles, or force majeure events shall extend delivery schedules proportionally. WebCraftiva will communicate any schedule adjustments within 48 hours of identification.
3. PRIVACY POLICY & DATA PROCESSING (GDPR)
In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation), personal contact data submitted via our consultation consoles, email correspondence, or telephone channels is processed exclusively for client communication, project delivery, invoicing, and statutory tax reporting obligations.

Categories of Personal Data: We collect and process the following categories of personal data: full name, email address, telephone number, company name, project specifications, and any voluntarily provided creative briefs or business documentation.
Legal Basis for Processing: Personal data is processed on the basis of contractual necessity (Article 6(1)(b) GDPR) for the performance of our creative services, and on the basis of legitimate interest (Article 6(1)(f) GDPR) for direct marketing communications related to existing service engagements.
Data Retention: Personal data is retained for the duration of the active client relationship and for a period of 7 years following the final invoice, in compliance with Swedish bookkeeping legislation (Bokföringslagen, Chapter 2). Project files and creative deliverables are retained for 3 years post-delivery unless otherwise agreed.
Data Security: All personal data is securely stored within encrypted EU-hosted cloud systems in compliance with ISO/IEC 27001 standards. We employ TLS 1.3 encryption for all data in transit and AES-256 encryption for data at rest. Access controls follow the principle of least privilege.
Third-Party Sharing: We never sell, rent, or distribute personal information to unauthorized third-party data brokers. Personal data may be shared with: (a) payment processors (Stripe) for transaction processing, (b) email service providers for correspondence delivery, and (c) hosting infrastructure providers (Cloudflare, AWS) for service delivery. All third-party processors operate under Data Processing Agreements (DPAs) compliant with Article 28 GDPR.
Your Rights: Under the GDPR, you have the following rights: (a) Right of Access (Article 15), (b) Right to Rectification (Article 16), (c) Right to Erasure (Article 17), (d) Right to Restriction of Processing (Article 18), (e) Right to Data Portability (Article 20), (f) Right to Object (Article 21), and (g) Right to Lodge a Complaint with the Swedish Authority for Privacy Protection (IMY). Automated Decision-Making: WebCraftiva does not engage in automated decision-making or profiling that produces legal effects concerning you or similarly significantly affects you.
4. CCPA COMPLIANCE (CALIFORNIA CONSUMERS)
If you are a California resident, the California Consumer Privacy Act (CCPA) grants you additional rights regarding your personal information. WebCraftiva complies with the CCPA for all California-based clients and website visitors.
Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of collection, the business purposes for collection, and the third parties with whom we share personal information.
Right to Delete: You have the right to request deletion of your personal information, subject to certain exceptions such as legal compliance obligations, security purposes, and the completion of contractual obligations.
Right to Opt-Out: WebCraftiva does not sell personal information as defined by the CCPA. No opt-out mechanism is required.
Non-Discrimination: WebCraftiva will not discriminate against you for exercising your CCPA rights. We will not deny services, charge different prices, or provide a different quality of service based on privacy choices.

6. REFUND & REIMBURSEMENT POLICY
WebCraftiva is committed to delivering creative services that meet or exceed client expectations. This refund policy outlines the conditions under which refunds or partial reimbursements may be issued.
Deposit & Milestone Payments: Projects are typically initiated with a non-refundable deposit of 40-50% of the total project value, which covers initial creative development, resource allocation, and project planning. Subsequent milestone payments are due according to the agreed project schedule.
Full Refund Conditions: A full refund of the deposit may be issued if: (a) WebCraftiva fails to commence work within 10 business days of the agreed start date without valid cause, (b) the project is cancelled by WebCraftiva due to internal capacity constraints, or (c) the delivered work fundamentally deviates from the contracted scope and cannot be remediated within 2 revision cycles.
Partial Refund Conditions: A partial refund proportional to undelivered work may be issued if: (a) the Client cancels after work has commenced but before project completion, (b) the scope is materially reduced from the original contracted deliverables, or (c) mutual agreement determines that continued engagement is not viable.
No Refund Conditions: Refunds will not be issued for: (a) work that has been delivered and approved by the Client, (b) delays caused by Client non-responsiveness or late feedback exceeding 15 business days, (c) creative direction changes after approved milestones, or (d) third-party costs incurred on behalf of the Client (hosting, domain registrations, stock assets).
Refund Request Process: All refund requests must be submitted in writing to [email protected] within 30 calendar days of the event triggering the refund request. WebCraftiva will review and respond within 10 business days. Approved refunds are processed within 14 business days to the original payment method.
7. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, WebCraftiva's total aggregate liability for any claims arising out of or related to our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
WebCraftiva shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the theory of liability.
WebCraftiva shall not be liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, power outages, internet disruptions, or actions of third-party service providers.
